PLEASE READ THIS DOCUMENT CAREFULLY. This is a legal agreement between you and Evertek Computer Corp. BY JOINING, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT
This Agreement sets forth the terms and conditions under which Evertek offers its products and services.
TERMS
No price protection or stock rotation:
Evertek does not offer any type of price protection or inventory rotation. We often drop prices suddenly and without notice.
We make every effort to provide information that is as accurate as possible. However, as all specifications and descriptions are supplied by the supplier of the product, we make no express or implied warranties as to the accuracy of any information, including the prices, descriptions, specifications and/or quantities. Product and manufacturer names are used for identification purposes only. Images are representative only. Actual unit packaging may vary.
Minimum order:
We sell wholesale ONLY. Minimum order is $100.00. For orders under $100.00, there is an additional $10.00. (International orders require a minimum of $1,000)
National terms of sale:
New National Accounts are usually set up on credit card terms (we accept Visa, MasterCard, or American Express.) For existing COD customers, we use a Check Guarantee Service for all COD Corporate Check mailings. If we are unable to obtain approval on your business check order, you will have the option of paying by Visa/Master Card/American Express or COD Cashier Check. Orders over $10,000 must be prepaid by wire transfer banking.
Company Cheques:
We cannot accept personal checks. The address printed on your business check must be the same as the shipping address.
Late fee:
Evertek charges a late fee (invoices unpaid for any reason) at a rate of 2% for the first 30 days overdue, 5% each month thereafter. We reserve the right to waive the fee at our sole discretion.
International Terms of Sale:
International sales are by prepaid bank transfer only. We do not accept credit cards or L/C letters of credit.
NSF Policy:
Any returned checks will disqualify the account from any future business check privileges and may be liable for treble damages, service charges, collection costs, and attorney's fees.
Credit Cards: (For US accounts only)
We ONLY accept Visa, Master Card or American Express! All credit card sales must be shipped to the credit card billing address.
Prices:
All prices are ex warehouse Temecula, CA, USA.
Disclaimer:
Evertek buys, refurbishes, and sells repaired goods. We are not authorized by Apple, or authorized by any major manufacturer, to perform repairs. The SOP is to interchange parts from like systems, but on occasion third-party parts may be used to make repairs. Additionally, units purchased by us for resale may contain the same. When selling any non-factory refurbished Evertek product, we ask that you accurately convey that these units are refurbished and may contain third-party parts.
International payment terms:
Payment terms for international sales are prepayment by bank transfer, in US dollars only. We do not accept international credit card payments or letters of credit (L/C). The customer is responsible for all charges deducted from wire transfer payments, including postage and intermediary bank charges. Please indicate “No Charges to Beneficiary” in the Reference section or other appropriate section of your wire transfer notice. Customer is also responsible for short payments resulting from fluctuations in currency conversions. Prior to shipment, Evertek will advise customer of changes to orders that are necessary due to underpayments received.
International shipments:
International customers are responsible for determining their country's duties, rates or taxes. For international shipments over 450 kg, we can provide prepaid freight quotes to major airports on a "door to airport" basis.
Truck shipments:
If no other shipping method is specified, Evertek will ship via the cheapest qualified carrier available. If this is an issue, be sure to specify how you would like an order shipped.( We only use reputable domestic carriers. Although you have the option of insuring your shipments by truck (common carriers like Yellow Freight, Roadway, etc.), it is STRONGLY advised that you purchase separate inbound insurance. Product shipments Computers are rated at 92.5 and trucking companies have a limited liability of $5.00 per pound if a box is lost or damaged. This means if a 30lb. box containing (10) hard drives is lost ( worth $80.00 each, the box is worth $800), the claim would only pay $5.00 x 30 books = $150.00.It is for this reason that we strongly suggest you to have insurance to cover you for such a situation.
You pay shipping costs:
When you place an order, after coming to the final confirmation page, we will immediately email you a confirmation of your order. If you find any errors, please contact us immediately. Freight may be empty on the confirmation.Once the shipping costs have been calculated and the order has been shipped, we will send you an email again with the shipping costs and tracking numbers.
Refused shipments:
If a shipment is refused for any reason, the customer is responsible for any freight charges incurred. Evertek also reserves the right to charge a 20% restocking fee (which we may also choose to waive).
Manufacturer Direct Warranties:
If there is a direct manufacturer's warranty, we request that you return the unit directly to the manufacturer, unless the unit is DOA (within 7 days of receipt).
Warranty limits:
Evertek cannot warrant an item that has been misused or physically damaged.
RMA:
RMA numbers are valid for 14 days after issue. After obtaining an RMA number, please send the item(s) immediately.
Suitability for purpose:
Evertek cannot guarantee any product to be suitable for any particular use or purpose. We strongly recommend that customers evaluate a sample unit to determine by their criteria if a product will perform in their configuration. computer, there are many products that may be incompatible with a certain brand or part. In such cases, it is your responsibility to resell the product in a standard application in which the part will work. We cannot take back parts. because they won't work in one particular branded product if they work fine in others.
Defective products:
Any damage resulting from a defective product shall be limited to a refund of the purchase price only. Defective items will be replaced with a repaired or refurbished unit (even for DOA). If no replacement unit is available within 30 days we will issue a credit note. Credits expire 6 months from the date of issue. A credit may be refunded if not used on an order for 30 days. Refunds will be made through the original method of payment used for purchase. RMA credits are for the product only and do NOT include reimbursement for shipping charges.
All sales are final:
All sales are final. Returns of products, other than defective, are subject to a 20% restocking fee. No returns are permitted after 14 days of receipt.
48 hour grace period for returns:
Returns are permitted, but only within 48 hours of receipt, for any order that does not meet your expectations. Returns after this period are at Evertek's sole discretion and will incur a substantial restocking fee.
Damaged items or missing parts:
Damaged items or missing parts/accessories not as advertised must be reported within 7 business days of receipt of product.
Repair under warranty:
All items returned for warranty repair must have been tested prior to return of the part. We will charge a service fee if we find a returned item in working condition.
Return of defective item:
Customer MUST CAREFULLY PACK returned defective items as if they were new and functional, with ALL parts and accessories originally included. FAILURE TO DO SO may invalidate both the RMA and the warranty.
LIMITED WARRANTY:
Warranties may be limited on certain items. Please consult our commercial documentation and your invoice to verify that the warranty meets your expectations.
